Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the SudSync mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). SudSync is operated by Pickleball Pen LLC, a Washington State limited liability company, doing business as SudSync.

If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Pickleball Pen LLC.

2. Description of Service

SudSync is a mobile platform that connects vehicle owners with independent mobile car washers (“Washers”). We facilitate the scheduling, payment, and management of exterior car wash services at locations you specify within our service area (Tri-Cities, WA).

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account and use SudSync.

3.2 Required Information

To use SudSync, you must provide:

• A valid email address
• A verified phone number
• A valid payment method
• At least one registered vehicle

3.3 Account Integrity

Each phone number may only be associated with one account. Creating multiple accounts is prohibited and may result in immediate termination of all associated accounts.

4. Booking and Service

• Wash appointments are available in time blocks up to 3 hours maximum, in 30-minute increments.
• Cancellations must be made at least 24 hours before the scheduled wash. Late cancellations may incur a fee.
• Your vehicle must be accessible at the specified location and time. Blocked, gated, or inaccessible vehicles may result in a no-show fee.
• Washers may apply a surcharge for heavily soiled vehicles, subject to your approval via the app.

5. Pricing and Payment

• Pricing is based on vehicle size and wash tier (Good, Better, Best).
• All prices are displayed in the app before booking and are in US Dollars (USD).
• We accept credit cards, debit cards, Apple Pay, and Google Pay, processed securely through Stripe.
• Prices may change at any time. Existing subscriptions honor their current pricing until renewal.

6. Subscriptions

• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You must cancel at least 24 hours before your next billing date to avoid being charged.
• We send a renewal reminder 3 days before your billing date.
• No partial refunds are provided for cancelled subscriptions mid-period.
• You may pause your subscription for a limited duration as configured in the app.

7. Tips

• Tips are voluntary and are 100% passed through to your Washer.
• You have a 24-hour window after wash completion to add a tip.
• Tips range from $1 to $100 per wash.

8. Wash Bundles

• Wash bundles are prepaid packages of washes purchased at a discounted rate.
• Bundles are non-refundable once purchased.
• Bundles are specific to the vehicle size selected at purchase.
• Bundles are non-transferable between accounts.
• Unused washes expire according to the expiration date shown at purchase.

9. Gift Washes

• Gift washes are redeemed using unique codes provided at purchase.
• Gift washes have an expiration date shown at the time of purchase.
• Gift washes are non-refundable and have no cash value.

10. Referral Program

• Referral rewards are earned after the referred customer completes their first paid wash.
• Rewards are non-transferable and have no cash value.
• Referral abuse, including creating fake accounts, using multiple accounts, or other fraudulent activity, will result in immediate account termination and forfeiture of all rewards.
• We verify referrals using phone verification, payment method verification, and address proximity checks.
• SudSync reserves the right to modify or discontinue the referral program at any time.

11. User Conduct

You agree not to:

• Create multiple accounts or impersonate another person.
• Engage in fraudulent activity, including referral fraud or payment fraud.
• Harass, abuse, or threaten Washers, support staff, or other users.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use automated systems, bots, or scripts to access the App.
• Interfere with or disrupt the operation of the App or our services.

12. Intellectual Property

All intellectual property rights in the App, including but not limited to the design, graphics, text, logos, and software, are owned by Pickleball Pen LLC. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

13. Wash Photos

Washers take before and after photos of your vehicle for quality assurance and documentation purposes. By using the service, you consent to these photos being taken and stored. Photos are not shared publicly without your consent and are used solely for service documentation.

14. Limitation of Liability

• SudSync shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability is limited to the amount you have paid to SudSync in the 12 months preceding the claim.
• SudSync is a platform connecting you with independent Washers. We are not directly responsible for the actions of Washers, though we maintain quality standards.
• If you believe your vehicle was damaged during a wash, you must report it within 48 hours of the wash completion.

15. Disclaimer of Warranties

THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Indemnification

You agree to indemnify, defend, and hold harmless Pickleball Pen LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, violation of these Terms, or infringement of any rights of a third party.

17. Dispute Resolution

• These Terms are governed by the laws of the State of Washington.
• Before filing any formal dispute, you agree to attempt informal resolution by contacting us for 30 days.
• Any disputes not resolved informally shall be settled by binding arbitration in Benton County, Washington, under the rules of the American Arbitration Association (AAA).
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class-wide arbitrations.

18. Termination

• You may terminate your account at any time by deleting it through the App.
• SudSync may suspend or terminate your account for cause, including violation of these Terms, fraudulent activity, or abusive behavior.
• Upon termination, your right to use the App ceases immediately. Outstanding payments remain due.

19. Modifications to Terms

We may modify these Terms at any time. For material changes, we will provide at least 14 days’ notice via the App and/or push notification. Your continued use of SudSync after the notice period constitutes acceptance of the updated Terms.

20. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pickleball Pen LLC.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
• Force Majeure: We are not liable for failure to perform due to circumstances beyond our reasonable control.
